Stressful period during Divorce and Separation

Separation
For a person to be able to file an Application for Divorce he or she will need to show that they have been separated for a total period of 12 months.  They are able to separate, reconcile and separate again, however the total period of continual separation should be not less than 12 months.

The parties are able to separate under the same roof.

Divorce
The Family Law Act 1975 establishes the principle of No Fault Divorce which means the Court does not need to consider why the marriage has ended.  Usually the only ground for Divorce is that the marriage has broken down irretrievably and that there is no reasonable likelihood that the parties will reconcile and commence to live together again.

Applying for a Divorce in Australia
You can apply for a Divorce in Australia if either you or your Spouse regard Australia as your home, are an Australian Citizen by birth, descent or grant of Australian Citizenship or ordinarily live in Australia and have done so for 12 months immediately before filing for Divorce.

You will need to satisfy the Court that you and your spouse have lived separately and apart for a minimum period of 12 months and that there is no reasonable likelihood of reconciling as Husband and Wife.
